Ukraine moves towards recognising European test reports

The Ukrainian Manufacturers of Transparent Structures (UMTS) association previously noted that recognising European test reports would simplify declaration procedures for Ukrainian enterprises. This issue was addressed within the framework of Law No. 12426, adopted by the Verkhovna Rada on 8 April 2026.

Today, window and door manufacturers face a specific problem. Test results already obtained in Europe are not automatically accepted by Ukrainian market surveillance authorities. As a result, companies are forced to retest their products and separately adapt technical documentation to Ukrainian requirements. This increases costs and delays products entering the market.

Law No. 12426 creates a regulatory framework to gradually remove these barriers. It establishes the principle of harmonising Ukrainian technical regulations with EU legislation. The Cabinet of Ministers will approve the list of such regulations. The law also provides for Ukraine’s integration into cooperation mechanisms with EU market surveillance authorities and the European Commission.

One of the key points for window manufacturers concerns the use of existing documents. The law states: “If a business entity provides expert opinions, product test reports, certificates of conformity or other documents confirming compliance with established requirements issued by accredited conformity assessment bodies, market surveillance authorities shall duly take such documents into account.” In practice, this means that reports issued by accredited EU laboratories will be considered, reducing the risk of repeated testing in Ukraine.

A separate provision concerns the ACAA Agreement (Agreement on Conformity Assessment and Acceptance of Industrial Products — the so-called “industrial visa-free regime”). In sectors covered by this agreement, products recognised by an EU Member State market surveillance authority as compliant or non-compliant with requirements will receive the same status in Ukraine.

The ACAA Agreement potentially covers 27 industrial product sectors, although implementation for Ukraine will begin gradually. At the first stage, three sectors are included: machinery and equipment, low-voltage electrical equipment, and electromagnetic compatibility (EMC) of equipment. The list may later expand to construction products and other sectors.

At the same time, the law does not introduce automatic recognition of all European test reports immediately. Actual simplification will depend on several factors: adoption of secondary legislation, updates to technical regulations, signing and implementation of the ACAA Agreement, the practices of market surveillance authorities, as well as the position of the Ministry of Economy and the National Accreditation Agency of Ukraine (NAAU).

The Cabinet of Ministers has been given one year from the publication date of the law to adopt the necessary regulatory acts for its implementation.

Previously, OKNA.ua reported that BM-Test and NIISK received the right to test windows and doors for official market entry.
