Since 6 January 2023, the Law of Ukraine "On the provision of construction products on the market", which implements Regulation (EU) No. 305, has been in force. A transitional period until 2025 applies to products introduced to the market under the old technical regulation (Resolution of the Cabinet of Ministers of Ukraine No. 1764). Earlier, Olena Voskobiinyk, Director of the Department of Technical Regulation in Construction of the Ministry for Communities, Territories and Infrastructure Development, emphasised that the Law "On the provision of construction products on the market" will come into full effect on 1 January 2026. However, DIAM representatives interpret that since January 2023, new construction products for the Ukrainian market had to be introduced under the new law. The two years until 2025 are a transitional period for products already on the market to be circulated according to the new rules. Therefore, during inspections of windows and doors, the Declaration of Performance of construction products must be presented.
DIAM stresses that a certificate of conformity does not prove that a product has been correctly placed on the market. Each product type requires a separate declaration, even if the only difference is the size of the window or door.
Manufacturers and suppliers must independently prepare declarations in the Unified State Electronic System in the field of construction (EDSB). Essential performance characteristics must be indicated in it:
- for windows and doors (excluding fire-resistant ones) – according to standard DSTU EN 14351-1:2020,
- for insulating glass units – according to standard DSTU EN 1279-5:2019.
DIAM representatives highlighted that the manufacturer or supplier is responsible for the accuracy of the data. If a particular characteristic is stated in advertising or labelling, it must also be declared.
Among the difficulties identified when preparing declarations are the limited choice of essential characteristics in the EDSB and the inability to select a conformity assessment body. In such cases, DIAM advises contacting the system’s technical support.
The Inspectorate urges window and door manufacturers not to delay and to start preparing declarations now, as the new rules will be fully enforced from 2026.
